I have a question regarding patents with regard to the international community.

Is a patent upheld according to each country in which it was applied for and granted? So if someone 'invents' something in...lets say France...but the patent is held in the U.S., is it legit to for that person to pursue the invention?

No, if it has already been "invented" and patented, then a person can not "invent" it in another country. It is not an invention anymore. They can not get a patent in any country when there is already a patent in the world on that product.

Lisa is correct. Please also keep in mind that if the French citizen only manufactures the product in France and only sells the product in France (or any other non-U.S. country), then they are fine. To infringe upon a valid U.S. Patent the infringer needs to either make, use, sell or import the infringing product in the United States.
